Festival & Event Terms

These Festival Terms (“Terms” or “Festival Terms”) contain the terms and conditions for festivals and Events (“Festival and Events”) hosted by Waterfront Blues Production LLC and our affiliated entities (“Waterfront Blues Production LLC,” “us,” “our,” or “we”).

If you purchase or receive a full-price, reduced-price, or free ticket to, or otherwise attend one of our Festivals, you will be deemed to consent to and accept these Festival Terms. These Festival Terms constitute a binding agreement between you and us. If you do not agree to be bound by these Festival Terms, do not purchase or accept a ticket to our Festival or Events or otherwise attend our Festivals.

Additionally, by using our website at https://www.waterfrontbluesfest.com/ (the “Website”), you agree to be bound by our Privacy Policy [https://waterfrontbluesfest.com/privacy-policy/] and Terms of Service [https://waterfrontbluesfest.com/terms-of-service/]. If you do not agree to be bound by our Privacy Policy or Terms of Service, do not use our Website.

To the maximum extent permitted by law, we reserve the right to change, add, modify, or remove portions of these Festival Terms at any time, which shall become effective as of the “Last Updated” date at the top of this page. You are responsible for reviewing these Festival Terms at all times. We may also post additional rules at Festivals and Events which, in certain cases, may modify or contradict these Festival Terms. Such rules shall govern in the event of a conflict.

Purchases and Refunds 

As described in greater detail in our Privacy Policy (linked above), we partner with Afton Tickets to sell tickets offered on the Website. When you purchase a ticket through the Website, you will be directed to a page hosted by Afton Tickets. Fees will apply.

All sales are final. We do not issue refunds.

By purchasing a ticket, the buyer understands that all tickets are non-transferable, non-refundable, and non-tax deductible. All sales are final. The show goes on rain or shine. 

Artists, lineup and schedule are subject to change without notice. Tickets purchased are for the Festival, not for one specific act or artist. 

Complimentary Tickets, Promo Codes and Festival Offers

Promo codes offered apply only to newly purchased tickets at the time you purchase them, if you enter a valid promo code. They may not be applied to any previously purchased tickets or any other ticket type. Promo codes may be valid only for specific periods, for specific purchasers, or for specific types of tickets or passes. You may not combine promo codes. If you receive a promo code, you may not share it with others without our consent. There are no rain checks or retroactive applications due to technical difficulties or any other issue that may prevent you from purchasing during the designated time period.

A limited number of tickets are available each day for Oregon Trail Card holders at no charge. Admission is limited to the cardholder plus one (1) member of their immediate family. All Festival passes are subject to availability and limited quantities are available. Oregon Trail Card holders will receive a 1-Day ticket and must enter the Festival upon presentation of their card, and are subject to the same access and restrictions for all 1-Day ticket holders, including no re-entry. Oregon Trail Card tickets are non-transferable.

Kids 12 and under are free of charge at the Festival (one child per paid accompanying adult). Children must be supervised by their accompanying adult. Children receive the same access and restrictions as their supervising adult ticket holders, including no re-entry for 1-Day ticket holders. Admission tickets for children are non-transferable.

Release of Liability

You assume all risk and danger arising from, or incidental to, the event for which the ticket is issued, whether such risks occur prior to, during, or subsequent to the Festival. You expressly release Waterfront Blues Production LLC, and its members, managers, subsidiaries, affiliates, licensors, suppliers, advertisers or sponsors, and  their directors, officers, employees, consultants, agents or other representatives (“Limited Persons”) from any and all claims that the you have or may have that arise from or are incidental to the event, including any claims arising out of the negligence of any released party. You knowingly and voluntarily assume all risk of property loss, personal injury, serious injury, or death, which may occur by attending the event, and hereby release, discharge and hold Waterfront Blues Production LLC and the Limited Persons harmless from any claim arising from such risk, even if (to the maximum extent permitted by applicable law) arising from the negligence of Waterfront Blues Production LLC, Limited Persons, or from third parties, and you assumes full responsibility and liability from your attendance at a Festival or Event..

Reservation of Rights

Waterfront Blues Production LLC and its employees and agents reserve the right to refuse admission to or eject any person whose conduct is deemed by the Festival, at the Festival’s sole discretion, to be undesirable, including, without limitation, disorderly conduct, use of vulgar or abusive language toward Festival staff or other attendees, violations of law, or failure to follow the Festival or venue or facility rules and directions. Undesirable conduct of any of the types expressly listed above will automatically terminate your license and rights to attend the Festival. The exercise of the Festival’s ejection rights hereunder does not entitle you to a refund of the ticket price or any part thereof.

Weather

The Festival, and all shows at the Festival and Events, will occur rain or shine, except as may be required by applicable law or safety concerns.

Photo/Video

Waterfront Blues Production LLC and its employees and agents may occasionally photograph or record (audio and/or visual) parts of the Festival. By attending the Festival, you irrevocably consent to such recording and the use of your image and/or voice for news, marketing, and publicity purposes, in print, television and on the web. If you do not want to be photographed, please inform the photographer or email info@waterfrontbluesfest.com.

No video or audio recording of shows are permitted without permission from the individual artists. Prior authorization and appropriate on-site media credentials from the Festival are required.

Entry Search 

You and your belongings are subject to search upon entry to the Festival. The Festival will not be responsible for lost, stolen, or damaged items. The following items are not allowed at the Festival:

  • No outside food and beverages, other than factory-sealed or empty water bottles
  • All bags are subject to size restrictions, and must not exceed 18″ x 6 “x 12”. Clear bags are encouraged, but not required.
  • Cannabis, drugs, outside alcohol and other controlled substances
  • Coolers of any kind
  • Smoking, vaping, or chewing tobacco
  • Umbrellas, tents or canopies
  • Oversized blankets
  • Carts or wagons
  • Weapons of any kind
  • Fireworks, explosives, or accelerants of any kind
  • Drones
  • Balloons, beachballs, frisbees, inflatable devices, or outdoor games
  • Professional audio or video recording devices and equipment, including cameras with a detachable lens longer than 4″
  • Animals, except service animals
  • Glass of any kind

 

All attendees and their belongings are subject to search upon entry. The festival is not responsible for lost, stolen or damaged items.

General Festival Rules and Reminders

  • Per the City of Portland, all Portland Parks are designated as smoke-free areas.
  • Dispose of trash and recycling in designated receptacles.
  • No physical or verbal harassment or abuse of any kind will be tolerated.
  • Please do not block aisles, walkways, esplanade, or other public areas.
  • Please follow the guidelines and directions of the Festival management team and its authorized contractors, as well as all posted signage.
  • Please follow all federal, state and City of Portland laws, ordinances, rules, and regulations.
  • Festival staff will close entry to Waterfront Park when the audience reaches capacity, as directed by the City of Portland Fire Marshal.
  • No video or audio recording of concerts without permission from artist.
  • No distribution of commercial advertisements, or vending without authorization.
  • No re-entry with 1-Day tickets.
